WAAM, L.L.C. Waiver and Release of Liability Agreement to Participate
This is a release of liability and that it is waiving the right to sue for certain damages.
READ BEFORE SIGNING
The risks of injury and illness when training in combat sports such as Martial Arts (ex: bruises, strains, sprains, muscle tears, bone breaks, teeth/mouth injury, cuts, concussion, and communicable diseases such as MRSA, Staph, fungal infections, influenza, and COVID-19) to myself and/or child(ren) from the activities involved in these programs are significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce these risks, the risks of serious injury and illness do exist.
FOR MYSELF, SPOUSE, AND CHILD(REN), I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for myself and/or child(ren)s participation; and,
I willingly agree to comply with the program’s stated and customary rules, terms and conditions for participation. If I observe any unusual significant concern in my or my child(ren) readiness for participation and/or in the program itself, I will remove myself and/or child(ren) from the participation and bring such attention of the nearest coach immediately; and,
I certify that Myself, and/or Child(ren) am physically fit and have no adverse physical condition that would prevent or inhibit my/their participation in any Activity. I have informed the class coach of any conditions that may affect my/their ability to participate in the Activities and understand and agree that in permitting me and/or my child(ren) to participate in the Activities of WAAM, L.L.C. and their coaches has relied on my representation that I and/or my child(ren) am/are in good health. If at any time I believe that I and/or my child(ren) am/are unable to participate in the Activities due to physical or medical conditions, I will immediately discontinue my and/or Child(ren) participation and will notify coaches of such condition. In the event that emergency medical treatment of me and/or my child(ren) appears to be necessary during any Activity, I consent to such treatment by any local responders or caregivers, if available.
I myself, my spouse, my child(ren), and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS WAAM, L.L.C.; its Members, officials, agents, employees, volunteers, coaches, contractors, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners, managers, and lessors of premises used to conduct the event (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property incident to my or my child(ren) involvement or participation in these programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
I, for myself, my spouse, my child(ren), and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releasees from any and all liabilities incident to my involvement and/or my child(ren) or participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law.
I, the parent/guardian, assert that I have explained to my child/ward: the risks of the activity, his/her responsibilities for adhering to the rules and regulations, and that my child/ward understands this agreement.
I/We further understand that my/our photograph/video may appear on social media or marketing for the business. I understand that there are no rights granted to me to inspect or approve photographs/video prior to publication or use of any kind. I/We understand that we may be on video while on the premise.
Membership Holds and Cancellations: I understand I must give notice of cancellation at least 30 days prior to the desired hold or cancellation date by a method that will allow me to prove that I gave notice, including a dated written notice, email, voicemail, or text message. It doesn't matter if the seller receives the notice within the required period as long as you sent it within the required period.
I, FOR MYSELF, MY SPOUSE, AND CHILD(REN)/WARD, HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

RULES OF THE JIU JITSU MATS and GYM
By acknowledging this form, you agree to comply to the following :

1. Leave your ego outside. Be mindful, humble, and respectful of others at all times.
2. ALWAYS wear shoes when coming to gym and while off the mats. Do not bring street shoes, clothes or dirty feet onto the mats. SHOES ARE REQUIRED AT ALL TIMES IN THE LOBBY AND BATHROOM.
3. If you will be late, please do not disturb the class during the demonstration.
4. ALWAYS wear clean uniforms (Gi & NoGi) when coming to gym. Appropriate uniforms for class can be found on our website or by asking staff.
5. No offensive odors allowed. This includes body, perfumes, smoke, or other odors deemed unfit by instructor. You may be asked to leave the mats for the remainder of the class if odors cannot be remedied.
6. ALL athletes are required to wear a rash guard under Gi top along with athletic undergarments under Gi bottoms. There should always be at least two (2) layers of cloth material worn for both Gi and NoGi classes. You may be asked to leave the mats if an instructor deems uniform does not comply with our standards.
7. Keep finger/toenails always cut short, hands and feet must be clean. Long hair must be tied back. Facial hair and long hair of any type will always pose a risk of being pulled or ripped out unintentionally. You are aware that this is a risk and accept those risks. An instructor may ask you to comply at any time if it is deemed an issue and you must leave the mats to correct before returning to class.
8. NO jewelry, piercings, or other body objects that may pose an injury risk to any person is allowed on the mats. NO metal, zippers, underwire, plastic groin, or chest protection allowed while training with others on the mats.
9. NOTHING is allowed on the mats that would cause damage (rips, tears, scuff marks, discoloration, make-up, dyes, holes, etc.) to the mats or another person’s uniform.
10. RESPECT: Give higher ranking belts preferred space while on the mats. Get “out of the way” during rolls when you encroach into higher belts space. ALWAYS be aware of your surroundings and maintain a safe environment when training.
11. ALWAYS use proper “TAP” out procedures to end contact, match, or round. Be clear and intentional with your “TAP” by (1) making clear contact with partner by clapping on them with hand or foot, (2) hitting the mat hard multiple times, (3) verbally speaking “TAP” loud enough for all others to hear.
12. Refer to gym instructors as “Professor”, “Coach” or “Sensei” while on the mats. Show respect by shaking ALL black belt hands at the beginning of class. This includes guest black belts.
13. If you have any infectious and/or contagious diseases, stay home. Cuts must always be covered. At the FIRST sign of any rash, lesion, or infection, stop training immediately and do not return to any class until it’s been treated and cleared by a medial professional.
14. Protection equipment such as mouth guards, head gear, joint braces and pads, and wrestling shoes may be worn on the mats as long as; (1) they are made of soft material that will not cause injury or damage to others or the mats, (2) they are clean, (3) they are not worn to the gym but put in place after arrival.
15. You are responsible for your child(ren)s behavior at all times before, during, and after class while at the gym. We do not have childcare available and are not responsible to watch or babysit your child(ren) outside of their class time.
